STARMINER END USER LICENSE AGREEMENT

This End User License Agreement ("Agreement") is a legal agreement between you and Cool And Good Games d.o.o., Kotnikova ulica 5, 1000 Ljubljana, Slovenia ("we", "us", "Cool And Good Games") for the video game Starminer, including all related software, updates, patches, downloadable content and documentation (together, the "Game").

By installing, accessing or playing the Game you agree to this Agreement. If you are under the age of majority in your jurisdiction, a parent or guardian must accept this Agreement on your behalf. If you do not agree, do not install or play the Game.

The terms of the platform or store through which you obtained the Game (for example, the Steam Subscriber Agreement if you obtained the Game through Steam) also apply to your use of that platform. In case of conflict regarding the Game itself, this Agreement prevails.

1. LICENSE

Subject to this Agreement, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play the Game on devices you own or control, for your personal, non-commercial entertainment use.

The Game is licensed to you, not sold. We and our licensors retain all right, title and interest in the Game, including all copyrights, trademarks, code, artwork, music, text, game design and other content. All rights not expressly granted to you are reserved.

2. RESTRICTIONS

You may not:

• a) copy, distribute, sell, rent, lease, lend, sublicense or otherwise transfer the Game or any part of it, except as expressly allowed by the platform through which you obtained it;
• b) reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of the Game, except to the extent such activity is expressly permitted by applicable law notwithstanding this restriction;
• c) modify the Game or create derivative works of it, except as permitted in Section 6 (Mods and User Creations), or remove or alter any copyright, trademark or other proprietary notice;
• d) use cheats, exploits, automation software, bots, hacks or any unauthorised third-party software that modifies or interferes with the Game or its online services, except Mods permitted under Section 6;
• e) interfere with, disrupt or abuse the Game's online services, other players, or the servers and networks that support the Game;
• f) use the Game for any commercial purpose, including public performance, without our prior written permission.

3. ONLINE FEATURES AND ACCOUNTS

Some features of the Game require an internet connection and use online services such as player profiles, leaderboards and player statistics. We may modify, suspend or discontinue any online feature at any time, and we do not guarantee that online features will be available for any particular period.

You are responsible for any account credentials associated with the Game and for all activity under them.

4. UPDATES

We may provide updates, patches and changes to the Game from time to time. Some updates may be required to continue playing, and updates may add, change or remove content and features. This Agreement applies to all updates unless a separate agreement accompanies them.

5. VIDEOS, STREAMING AND SCREENSHOTS

You may create and share videos, streams and screenshots of your gameplay, including on monetised channels, provided you do not present them as official material of Cool And Good Games and do not use them to promote cheats or unauthorised software. We may revoke this permission for content that violates this Agreement or applicable law.

6. MODS AND USER CREATIONS

We welcome mods. You may create modifications, add-ons and tools for the Game ("Mods") using the Game's files, and share them with other players, subject to the following:

• a) Mods may be distributed only free of charge and for non-commercial use. Voluntary donations to a Mod's creator are permitted.
• b) Mods remain the property of their creators. However, a Mod may not redistribute the Game's assets as a standalone package, and may not be used in a way that lets people play the Game without a licensed copy. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display and promote your Mods in connection with the Game and its marketing.
• c) Mods must not cheat, exploit or interfere with the Game's online services, other players, or the servers and networks that support the Game.
• d) Mods must not contain content that is unlawful or infringes third-party rights.
• e) Mods are used at your own risk. We do not support or warrant Mods, and we may change the Game in ways that break existing Mods without notice.

We may publish official modding features or guidelines from time to time. Where they conflict with this Section, the guidelines apply. We may withdraw this permission for a specific Mod that breaches this Agreement or applicable law.

7. THIRD-PARTY SOFTWARE

The Game includes software and content licensed from third parties. Notices for third-party software are provided in the Game and in the third-party notices file distributed with it. Your use of the Game is also subject to those notices where they apply.

8. UNREAL ENGINE

Starminer uses Unreal® Engine. Unreal® is a trademark or registered trademark of Epic Games, Inc. in the United States of America and elsewhere. Unreal® Engine, Copyright 1998 - 2026, Epic Games, Inc. All rights reserved.

Epic Games, Inc. and its affiliates ("Epic") are not parties to this Agreement and have no obligations to you under it. Epic is a third-party beneficiary of this Section 8 and may enforce it.

THE UNREAL ENGINE AND ANY OTHER EPIC TECHNOLOGY INCLUDED IN THE GAME ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EPIC DISCLAIMS ALL REPRESENTATIONS, WARRANTIES, CONDITIONS AND LIABILITIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, RELATING TO THE UNREAL ENGINE OR ANY EPIC TECHNOLOGY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SOFTWARE IS FREE OF DEFECTS OR ERRORS. IN NO EVENT SHALL EPIC BE LIABLE TO YOU FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO THE GAME OR THE UNREAL ENGINE.

9. DATA AND PRIVACY

Starminer is developed and published by Cool And Good Games d.o.o. (Ljubljana, Slovenia). When you play Starminer, we process limited personal data to operate the Game's online features:

• Authentication and player profiles are provided by PlayFab (Microsoft).
• Gameplay data such as leaderboards and player statistics is stored in PlayFab on our behalf.
• If you choose to send a crash report after a crash, technical data about the crash and your system is sent to our servers on Microsoft Azure. Sending crash reports is optional.
• If you choose to send feedback through the in-game feedback form, the message you type, your rating, the game version, basic system information (CPU, GPU, operating system) and your PlayFab player ID are sent to our servers on Microsoft Azure, together with a screenshot or save file only if you choose to attach them. Sending feedback is optional.
• If you opt in through the in-game prompt or the Options toggle, gameplay telemetry (such as game version, session length, map and gameplay milestones) is sent to PlayFab and linked to your PlayFab player ID. Telemetry also includes a flag indicating whether the previous session ended in a crash; this flag is independent of whether you chose to send a crash report. Telemetry is off by default and you can turn it off at any time in Options. Accepting this Agreement does not by itself enable telemetry.

By installing and playing Starminer you acknowledge that you have read and understood our Privacy Policy.

10. TERMINATION

This Agreement is effective until terminated. It terminates automatically if you breach any of its terms. We may also terminate or suspend your access to the Game's online features if you breach this Agreement. On termination you must stop using the Game and delete all copies in your possession. Sections 1 (ownership), 2, 6, 7, 8, 9, 11, 12, 13, 14, 15 and 16 survive termination.

11. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE OR COMPATIBLE WITH YOUR HARDWARE.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COOL AND GOOD GAMES AND ITS LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, SAVE GAMES, PROFITS OR GOODWILL, ARISING OUT OF OR RELATED TO THE GAME OR THIS AGREEMENT. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE GAME.

Nothing in this Agreement limits or excludes liability for death or personal injury caused by negligence, for fraud, for intent or gross negligence, or any other liability that cannot be limited or excluded under applicable law.

13. CONSUMER RIGHTS

If you are a consumer in the European Union, the United Kingdom or another jurisdiction with mandatory consumer protection laws, nothing in this Agreement affects the statutory rights you have under those laws, including rights relating to the conformity of digital content. Where this Agreement conflicts with such mandatory rights, the mandatory rights apply.

14. GOVERNING LAW AND DISPUTES

This Agreement is governed by the laws of the Republic of Slovenia, excluding its conflict-of-law rules. The courts of Ljubljana, Slovenia have jurisdiction over any dispute arising from this Agreement. If you are a consumer, you may also rely on the mandatory laws and courts of the country in which you reside.

15. GENERAL

This Agreement is the entire agreement between you and us regarding the Game and supersedes any prior agreements. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign this Agreement; we may assign it to a successor or affiliate. We may update this Agreement. Continued play after you have been notified of, or have accepted, an updated version constitutes acceptance of it. This does not affect your statutory rights.
